The transcontinental railroad was not built by consensus. It was built with capital, political backing, and a willingness to impose a new reality on the map. The towns on the line prospered. The others became geography.

But that’s not the whole story. The railroads did not cross empty land. They crossed farms, homesteads, and towns. They imposed first and compensated later. The lawsuits followed. Communities that might have become partners became enemies. The railroads changed the continent, but in the long run, US rail connectivity and innovation suffered.

But the West did not become the West by treating ownership as optional. It became rich by building, and it became durable by recognizing that progress without property rights has another name.

Google built a $2 trillion business on your data. Before they did it, they showed you the terms of service. You clicked agree. The consent was thin, arguably meaningless, but the principle was there: use their service and you pay with your attention, your information, your implicit permission. Now consider what drone operators are doing. They are not commoditizing your data. They are commoditizing your property, the airspace above land that US courts have recognized as private since 1946. A click on terms of services does not give property rights away.

American law has not treated the reaches above private land as a free good for whoever has the best lobbyist. The principle is not complicated. The law has been clear on one point: the space above land is not a corporate commons.

Property rights are not a legal technicality. They are the original political technology. Every major religious and philosophical tradition that contributed to the Western settlement, from the Hebrew prohibition on removing your neighbor’s landmark to Locke’s argument that a man’s labor makes land his own to the common law’s insistence that an Englishman’s home is his castle, understood the same thing. Without enforceable ownership, there is no freedom worth the name.

The low-altitude drone industry is mistaking unpriced property for progress. Economically, this is appropriation by externalization. Short-term margin is being created by ignoring the need for permission, shifting the burden onto landowners, communities, and cities, then pretending the downstream liabilities belong to someone else. They do not. They sit there, off-balance sheet, until they return as litigation, political backlash, compliance costs, and a legal premium large enough to choke the very market the industry claims to be building.

This is the difference between paying $1 today to get back $2, and taking $2 today to pay back $3 tomorrow. The first compound’s value. The second compound’s obligations. Much of drone delivery still pretends it is doing the first while quietly living off the second.

What looks like efficiency on a slide deck is often just someone else’s property being used for free, not breaking some cartel. The drone in the sky is a distraction. The real transaction is happening against the rights below it.

Which means that right now, every commercial drone operator flying repeated low-altitude routes over private land, or launching and landing from public spaces without permission, is stepping into legal territory it does not own or control. Every route drawn over a farmer’s field in Frisco, every repeated overflight above homes in Dublin, every commercial path over land whose owners were never asked, carries a cost that many operators still behave as if they can externalize forever. They cannot.

Every city allowing commercial flights over or from public parks, schools, civic buildings, and public approaches without a commercial framework is surrendering leverage for free while keeping the downside on its own books. If something goes wrong, the operator will talk about innovation. The city will get the phone calls, the hearings, the legal exposure, and the bill.

A city that gives away leverage for free will buy back control using taxpayers’ funds, later at a much higher price. This is not a future problem. The flights are happening now. A community that feels its air is being taken without consent does not become an advocate for urban air mobility. It becomes the coalition that kills it. We have already seen it. In College Station, resident complaints over Amazon’s drone noise were followed by Amazon’s departure.

In Richardson, residents pressed city leaders over noise and frequency, forcing the city into public mitigation mode. In Highland Village, the City Council deferred Wing's (Google) drone hub proposal without a vote, not to kill it, but to slow down enough to ask the right questions first. That is what deliberate governance looks like; the pattern is already visible. The benefits are narrow, immediate, and visible, while the burdens are diffuse, cumulative, and political. That is how industries create backlash, the lawsuits begin, and the economics that looked so elegant start to break down in the real world.

There are two models of how a government or a company can treat property it finds useful. The first asks permission, negotiates terms, and pays. The second declares the use necessary and proceeds. The first model built America on a principle that courts enforce. The second model is what you see when a collectivist type government decides that economic progress supersedes private property claims.

The residents of College Station and Richardson have noticed, and others are following. It is solvable. The governance infrastructure to do it exists. But the window for cities to adopt it on their own terms, rather than reactively and under pressure, is not permanent.

The family under the persistent drone route gets the noise. The landowner gets the uncompensated use. The neighborhood gets surveillance anxiety. The city gets the complaints, the hearings, the liability questions, and eventually the litigation. Packages are delivered to some in the community, while the burdens are imposed on others whose rights were never part of the transaction.

That is not a market; it’s a forced subsidy. A real market begins when owners can say yes, no, or name their price. This is not software against bad regulation. It is convenience against ownership, and once ownership becomes optional in the name of progress, the logic is no longer recognizably Western.

What is happening in Texas matters. North Texas is now the most concentrated drone delivery environment in the US. The FAA has, for the first time anywhere, authorized multiple competing commercial drone operators to share the same low-altitude airspace simultaneously, but it has not given them property rights, they have just taken them.

Individually, these look like routine local fights. Together, they are the first draft of a new settlement. The cities moving deliberately, Corinth, Addison, and Fort Worth, are asking the right questions. What do we permit? What do we restrict? What do we charge for? How do we account for the landowners below a corridor? How do we ensure that, when something goes wrong at a school, hospital, or residential block, there is a record showing the city was not asleep at the wheel and that liability is correctly assigned? That matters more than most people realize.

The governance layer is not about controlling drones. It is about protecting leverage. The cities that adopt this infrastructure now will define what urban air mobility looks like at scale. The ones that wait will spend more, with angrier residents, more hostile politics, and lawyers already circling overhead.

Every market that took something unpriced and made it tradable went through the same transition. Carbon credits. Spectrum auctions. The pattern is consistent. The asset exists before the market does.

The low-altitude air rights market is at that inflection point. The governance layer is not optional. I am writing that framework and building it with municipalities before the litigation, and the backlash writes it. This is so communities prosper through property rights and innovation, not get levied with all the burdens and none of the rewards.

The railways that brought communities with them built multi generational durable infrastructure. The ones that imposed first and cleaned up later spent decades in court, with poorer outcomes and called it progress anyway. History remembers the difference. The same will be true here.

The right to own property, the right of the individual to make decisions for themselves and their families, and the freedoms the West holds up as worth defending: these do not maintain themselves. If they are not actively protected, they get eroded at the margins. Quietly. Incrementally. And before you can say no, you are already part of the matrix.

Drones are tools that can genuinely help communities. New economic opportunities. Reduced traffic. Blood and organs are delivered faster than any ambulance. A morning coffee to your door. But drones need permission to operate in low-altitude airspace. They need permission from the property owner. They need permission from the individuals below. That is not red tape. That is the beauty of the right to own and control what’s yours, and for a community to own and control its air rights. When drones fly without that permission, they are doing something older than technology. They are taking property they do not own, redistributing gains at the expense of individual freedom, and doing it in the service of whoever wants centralised control. That is not innovation. That is a political act dressed up as a delivery service.

The solution is not to ban drones. The solution is to build a system where towns, communities, and individuals decide how their airspace is used, on what terms, and who gets paid when it is transited. Not drone companies arriving like uninvited guests and calling themselves Florence Nightingale. Permitted transit. Approved hardware. Communities own air rights that can now generate value for the people beneath them, rather than extracting value from them. The question is whether it’s embedded before the wrong hardware gets its claws in so deeply that the choice disappears.

There is a tidy categorisation that the drone industry likes to use. Commercial, hobby, and military. Three lanes, clearly marked, nothing to worry about. It is a useful fiction. What you call a hobby drone, a defence analyst calls a platform capable of military-type operations. Commercial drones carry payloads. Those payloads do not have to be coffee. They can be munitions. The lane markings are administrative. The hardware does not care.

China understood this early and built its entire industrial strategy around it. Military-Civil Fusion, codified in law in 2017, legally mandates that every Chinese civilian company share its technology, data, and hardware with the People’s Liberation Army (PLA) on demand. Not as a courtesy or voluntarily, but by law. The dual-use nature of Chinese hardware is not a design flaw or an unintended consequence. It is the architecture and its policy. And the hardware being discussed is not confined to military procurement programmes. It is the drone hovering above your neighbour’s garden. It is the delivery vehicle heading for your roof. It is the module inside the turbine on the hill above your town.

The evidence is not hard to find

In December 2025, the civilian container ship Zhongda 79 was photographed at Shanghai’s Hudong-Zhudong shipyard undergoing military hardware installation. Containerised weapon modules, close-in weapon systems, and vertical-launch systems with radar. The Chinese markings on the equipment translated to “containerised weapon module development kit.” The ship appeared equipped with 60 vertical-launch system cells, with collaborative-combat aircraft drones visible nearby. Chinese and Hong Kong-flagged container and dry bulk vessels total 4,339 ships, roughly 20 percent of the global fleet. The U.S. flag total in those same categories is 63.

The Zhu Hai Yun sails as the world’s first civilian drone carrier for ocean science. China describes it that way. It has also operated in the Philippine sea zones without authorization. The vessel deploys more than 50 aerial, surface, and underwater drones to conduct 3D reconnaissance across nearly 100 miles. The civilian science framing falls apart quickly. Zhuhai Yunzhou Intelligence’s founder described his firm as “a model of military-civil fusion,” built to “lead the military with civilian innovation.” The company worked with the PLA Navy Marine Surveying and Mapping Institute in Antarctica. It supplied unmanned ships to Harbin Engineering University, a PLA feeder institution sanctioned by the United States in 2020.

The Jiutian is an airborne mothership capable of launching more than 100 drones per mission. Sixteen tons. A 25-metre wingspan. An operational ceiling of 15,000 metres. Twelve hours airborne. Targets up to 7,000 kilometres away. Chinese sources describe its dual-use roles.

Cars as drone launchpads

In March 2025, BYD and DJI launched the Lingyuan system, a roof-mounted drone dock integrated directly into BYD vehicles. A 4K drone in a rooftop station. Takeoff and landing while the car is moving at up to 25 kilometres per hour. The concern is not that BYD has become a drone manufacturer. The concern is that consumer automotive platforms are being fused with deployable drone infrastructure, normalised through the language of lifestyle and convenience, and distributed at scale into Western cities before anyone has asked who controls the off-switch. DJI is on the U.S. Department of Defense’s Section 1260H list of Chinese military companies. Features like autonomous tracking, AI navigation, and rapid vehicle-based deployment are consumer-facing on the surface. They mirror battlefield Intelligence, Surveillance, and Reconnaissance (ISR) requirements underneath.

A September 2025 report from the Center for Security and Emerging Technology documented a web of smaller Chinese tech companies operating across both domains simultaneously. Beijing SOUVI Information Technology received PLA contracts for drone control systems and intelligent sensing software that enable a single operator with minimal training to steer a swarm of drones. JOUAV markets vertical takeoff and landing drones with AI-fused thermal sensor data, enabling a non-military crew aboard a fishing vessel to detect other ships at night or in poor weather, turning a civilian boat into an intelligence, surveillance, and reconnaissance node.

The Pentagon’s annual China military power reports have flagged China’s civilian roll-on roll-off fleet, the same ships used to export BYD cars to Europe, as dual-use amphibious assets. Between May and July 2022, two Chinese civilian RO-ROs participated in exercises involving a floating causeway system designed to disembark forces onto a beach without seizing a port. The dual-capable civilian fleet could exceed the combined displacement tonnage of all U.S. Navy amphibious assault ships.

In October 2024, China formalised what was already true. New Export Control Regulations on Dual-Use Items, effective December 2024. Drones, AI. chips, quantum computing, EVs, and rare earths. Beijing put it in writing: these are national security instruments, not just commercial products.

This is where approved hardware lists stop being bureaucratic annoyances and start being acts of sovereignty.

If a drone wants to transit the airspace above a town, above a family’s property, above a hospital, a school, or a reservoir, the community below should know exactly who and what is overhead. Who manufactured it, under what legal framework that manufacturer operates, and whether a state adversary holds a legal claim on the device’s cooperation. Is the operator complying with local rules and community regulations, and can the property owner then choose to permit its entry or exclude it? That is not paranoia. That is the minimum due diligence any property owner would apply to anyone crossing their land. The sky is not different because it is invisible. It is property. It generates value. It carries risk. It deserves the same framework of rights and permissions that applies to the ground beneath it.

No permit, no transit. No transit, no revenue. That is how property rights work. That is how air rights work.

The Secret Service has eyes

Sir Richard Dearlove ran Britain’s foreign intelligence service during the peak years of China’s economic opening into the West. He personally led the effort that eventually led to Huawei's removal from the U.K.’s 5G programme. He is not someone who recently stumbled onto this issue. When he writes in The Spectator that Chinese cellular modules embedded inside civilian hardware, EVs, wind turbines, and grid switching systems can all be reprogrammed remotely by the Chinese manufacturer after installation, without the knowledge or consent of the operator, that sentence carries forty-five years of professional weight behind it.

The scenario Dearlove describes is precise. China invades Taiwan. The West enters a military confrontation with Beijing. Within hours, the CCP orders every Chinese EV on every British road simultaneously immobilised. Supply chains collapse. Emergency services stop. Military logistics fail. One decision. One signal. Civilian infrastructure becomes a weapon.

If that sounds like a thought experiment, here is the proof of concept. When Russian forces rolled into Ukraine and seized John Deere equipment, tractors, combine harvesters, and farm machinery, they loaded it onto trucks and drove it back across the border. They expected to use it. They did not. John Deere logged into its remote management system from an office in America and activated a kill switch. Every stolen vehicle stopped working. Not disabled at the border. Not intercepted in transit. Bricked remotely, after the fact. The Russians were left with expensive scrap.

The kill switch was not built as a weapon. It was an anti-theft feature, the kind of thing you build so a farmer who cannot make payments does not disappear with a $400,000 combine. It became a weapon anyway, because the capability existed and someone decided to use it.

Now scale it. Replace John Deere with a Chinese drone manufacturer operating under a legal framework that requires full cooperation with the PLA on demand. Replace a Ukrainian field with every sky above the United States. Replace one kill switch with modules embedded across tens of thousands of vehicles, grid switching systems, wind turbines, and drones, all reprogrammable remotely, post-installation, without the operator’s knowledge and without any ability to block it.

The capability exists. It has been demonstrated in an active war. The only question is whether it is deployed by a civilian company protecting its assets, or by a state that has publicly declared its intention to achieve global technological dominance by 2049 and legally mandates that its manufacturers cooperate when asked.

At the margins

Cheap EVs. Cheap drones. Promises of blood deliveries, organ transport, and morning coffee sent straight to your door. Up close, they are the infrastructure of someone else’s off-switch gathering data as they fly.

The drone industry has a DJI problem. More precisely, it has a problem with people who do not think that DJI is a problem.

DJI holds somewhere between 70% to 80% of the global civilian drone market. It sits on the Pentagon’s list of companies allegedly supporting China’s military. It operates under China’s 2017 National Intelligence Law, which requires every Chinese company to cooperate with the PLA and state intelligence services on demand, no questions and no refusals. And yet a well-funded, well-organised effort has been running in Washington to ensure that none of that is treated as disqualifying.

Enter the Drone Advocacy Alliance. Multiple outlets reported that DJI took an outsized role in creating it. InfluenceWatch identified DJI as a sponsor and key force behind it. The Alliance’s public position was clean and simple: DJI drones are lifesaving tools, the bans are overreach, and the national security concerns are overblown.

In May 2024, Reps. John Moolenaar and Elise Stefanik wrote to Attorney General Merrick Garland asking the DOJ to investigate whether the Alliance should register under the Foreign Agents Registration Act, on the basis that it was lobbying on behalf of a Chinese military-linked company while systematically downplaying DJI’s ties to the PLA and CCP. Their letter was direct. DJI was using the Alliance to market its products as benign, while the lawmakers argued the opposite was the case.

That is an allegation by two members of Congress, not a court finding. No charges. No registrations forced. Whatever investigation followed produced nothing public.

But that is not really the point. The point is the architecture. A Chinese company with documented military ties funds an advocacy group. The advocacy group lobbies against restrictions on that company’s hardware. A prominent drone media voice, DroneXL’s Haye Kesteloo, one of the most widely read people in the industry, publicly opposes the bans and then, in June 2024, announces DroneXL has joined the Alliance. Nobody is obliged to assume bad faith. Kesteloo has not been accused of being a foreign agent or a registered lobbyist.

But those who have been watching China’s playbook for longer than the drone industry has existed will recognise the shape of this. You do not need to bribe or secretly recruit anyone. You just need the information environment to stay friendly while the hardware gets embedded deep enough that removing it becomes politically and economically unthinkable. At that point, the kill switch question answers itself.

The answer to that architecture is not a louder argument. It is a better system.

The drone companies that have been operating as if the sky is a commons they are entitled to cross without asking, framing themselves as emergency medical services while quietly building dependency on hardware that whispers to Beijing, are describing a world where their convenience is your obligation.

That world only works if you allow the property-rights question to go unanswered long enough for the infrastructure to become a fait accompli. The drone operators taking property rights, knowing what is at stake, are the modern-day Mustapha Mond, and they are the mechanisms by which that question gets answered before the PLA arrives.

Who controls the low-altitude infrastructure that runs through everyday life, and what happens when that question is answered before most people even think to ask it? Property rights. Air rights. The individual’s ability to make decisions for themselves and their families. These do not announce their erosion. They dissolve at the edges, slowly, in the language of consumer convenience, clean energy, and lifesaving technology, until one morning the infrastructure that was supposed to serve you has a different master.

The hardware is already here. The law that controls it never left China.

The sky above your town is yours. The question is whether you claim it before someone else decides the matter for you, installs the off-switch, and tells you to be grateful for the delivery.

Often quoted, George Washington put it clearly, “Freedom and Property Rights are inseparable. You can’t have one without the other.” Even Obama, writing before his presidency, captured the constitutional point crisply: “Our Constitution places the ownership of private property at the very heart of our system of liberty.”

That proposition is not in tension with a dynamic, technology-driven economy. It is the condition for it. The drone/UAS economy, especially in commercial delivery, inspection, mapping, agriculture, construction, and logistics, will scale fastest and with the least backlash when built on predictable property rules that enable contracting and corridor design, rather than on legal ambiguity or de facto uncompensated access.

The hard question is not whether drones will be useful. They will be. The hard question is whether American drone integration will respect (1) the common-law right to exclude, (2) the Fourth Amendment’s property-based limits on government intrusion, and (3) the Fifth Amendment’s demand for compensation when government takes an invasion right. The answer will determine whether drones become a source of broad-based prosperity or continue to be a generator of conflict, litigation, and regulatory overreaction.

Commercial drones routinely operate in ways that ignore property rights in the United States, as policymakers argue about supply chains, geopolitics, and national security, low-altitude air has become economically real.

This is the core failure. Not technology. Not Chinese or US manufacturing. Not a lack of federal or state authority. The failure is that low-altitude air, the space where drones actually fly, is underutilized and unpermitted.

Progress toward the “flying car” has not stalled because the machines are incapable. It has stalled because we have not embraced ownership of air rights and consent.

The total US drone market size was $25B in 2024, rising to $30B in 2025 and projected to reach $450B over the next five years, according to Ark Invest, assuming low-altitude private airspace becomes accessible. That growth sits on top of a fragile supply chain reality that keeps Chinese DJI as the default. The Commerce Department states that DJI controls about 70% of the global commercial drone market and a similar share in the US.

That dominance is most evident in public safety. DJI drones are heavily used by US public safety agencies, which is why every attempt to “ban” foreign drones quickly morphs into an exemption regime. On the commercial delivery side, open sources rarely let you prove a clean “uses Chinese parts” claim, because operators do not publish bills of materials. Chinese firms, especially DJI, dominate the complete systems market.

Everything that follows, from FCC bans to Commerce Department reversals, from Chinese drone promoters pretending to be concerned citizens to China hawks in Congress and exemptions buried in agency guidance, is downstream of this. Washington is fighting a supply chain war, while homeowners, towns, states, and real estate owners are poised for significant commercial gains.

Recent federal guidance indicates a greater focus on enabling drones and air taxis to take to the skies. For example, Missouri proposes to tighten and expand “unlawful use” rules governing where drones may be operated, particularly near critical infrastructure and open-air facilities, and to increase penalties for certain conduct. If it moves, it is a bill that can quickly change where lawful operations are permitted, even when FAA flight rules are met. This is a clear development of local laws taking control of low-altitude airspace.

In Hidden Hills, California, it is very clear that air rights are key to drone use. Nationally, operators often claim the rules are unclear, which is not the case. This is newspeak for we don't like the way we don't have free reign over your sovereign rights.

By default, drones cannot fly without the permission of the air rights owners. Hidden Hill has documented it, so there is no dispute. They prohibit flying over private property without permission.

Federal Moves & States Push On

We are feeling that recognition again. New markets, in real time, turning the sky from a symbolic backdrop into functional infrastructure. Something long delayed is becoming inevitable.

The next chapter of mobility is not theoretical. Centrally planned economies beholden to an ideology do not benefit the majority on whom they are imposed; a few top-level mandarins prosper, but the citizen finds himself and his aspirations crushed by the dictates of the central government. The nation state itself is similarly confined by a set of self-evident truths that constrain its policy-making and exclude challenge. Innovation becomes a slogan rather than an outcome. Progress becomes something issued from a podium rather than built from the ‘ground’ up.

The United States, mainly, operates under a different logic. The constitutional split between Washington, the states, and the property owner looks inefficient only to the untrained eye. In reality, it is the hidden engine of American breakthroughs.

Low altitude air rights sit with states and citizens. Federal policy has shifted from obstruction to ignition. And the FCC’s ban on Chinese drones and key components has cut a tether to foreign dependency.

China has already run the central planning experiment in drones. Through its Made in China 2025 industrial strategy Beijing treated unmanned systems as a strategic sector, mobilising state banks, tax breaks and subsidies on a scale estimated in the hundreds of billions of dollars. The result is dominance by a single national champion rather than a genuinely competitive market. DJI today is estimated to hold around 70% - 80% of the global civilian drone market and roughly 80% - 90% of the U.S. consumer segment, with some analyses placing its global share even higher. China as a whole produces about 70% - 80% of the world’s commercial drones and accounts for close to 79% of global drone related patents (fwiw), backed by clustered manufacturing in Shenzhen. From a distance this looks like a triumph of industrial policy. Up close it looks like a single country controlling the hardware stack for everyone else.

Faced with that reality many Western voices now argue for a Chinese style response. The U.S. has already created a Blue sUAS list for “approved” non Chinese platforms and trade groups call for higher tariffs on subsidised imports to blunt dumping. But copying the logic of Made in China 2025 could be a category error, if it goes beyond leveling the playing field. The U.S. advantage won’t come from a single national champion blessed by the nation state. It comes from millions of owners, builders and firms operating in a framework of clear property rights and competitive federalism. The correct answer to Chinese centralisation is not more central planning. It is market allocation or air rights and individual sovereignty.

For more than a decade, the commercial drone sector has moved at a snail's pace, markets growing on paper while deployments remain stuck in pilot mode. Analyst reports value the global commercial drone market somewhere between about $11 and $30 billion in 2024, with forecasts that more than double this by 2030, yet industry veterans stuck.

Promoters of DJI are worried. Infrastructure must be resilient and not dominated by any one vendor, stack, or country. Hardware, including tracking nodes and radar, is the same. No single point of failure if success is the goal.

In a unanimous 3–0 vote, the FCC just tightened its rules to close loopholes in its Covered List framework, the list for gear deemed an “unacceptable” national‑security risk. Until now, bans have hit only “new” devices from names like Huawei and Hikvision.

In College Station, Texas, Amazon’s delivery drones were so noisy that neighbors dubbed them “flying chainsaws” and likened the constant buzz to a lawn leaf blower running all day. Complaints over noise, privacy, and trespass mounted, with hundreds of residents and even city officials opposing expansion of the drone flights. Ultimately, Amazon shut down its College Station drone trial, not due to technical failure but community resistance over trespass and air rights.

Similar stories are playing out globally. In Ireland, locals describe the drone sound “like a motorbike overhead” tolerable perhaps for emergency uses but not for mere fast food drop-offs. Yet whenever innovation emerges, the knee-jerk reaction is often: “We need new laws for this!” But do we really?

History and experience show our age-old common law can handle this perfectly, does not require millions of taxpayer dollars, is better and more flexible than any sprawling new regulatory code, and protects our freedoms.

In the United States, it’s “black-letter law” (a settled legal principle) that landowners own the airspace above their land. The Supreme Court recognized that property isn’t just a two-dimensional concept. If something like a noisy/nosy drone invades the usable air just above your yard, it’s your business, not the government’s.

In legal terms, drone overflights implicate trespass and even takings law​. A drone hovering 100 feet over your backyard without consent is as unlawful as your neighbour’s dog traipsing through your garden.

This means that even without a single new “Drone Regulation Act,” you as a property owner already have recourse. If a delivery drone buzzes low over your house, you could sue for trespass or seek an injunction under existing law. Conversely, if a drone company wants access through your airspace, it can pay you. Essentially, rent for a slice of sky.

Any government rule that simply grants drones free rein over private yards is the taking of property and requires just compensation. I don't see a line in any state or federal budget to pay all real estate owners for their air rights to subsidise commercial drone or flying car companies.

Using the existing helicopter infrastructure and with a one-way flight estimated to be marketed at $200, this flying taxi could be considered a shinier chopper.

Think about these air taxis crisscrossing a city. Rather than having a bureaucracy carve up the sky in advance and taking private property, we lean on automatically negotiated air rights. If a flying car’s route crosses certain buildings at low altitudes, the operator can use a platform such as SkyTrade to contract for those air rights in a voluntary, market-driven approach or face lawsuits if they refuse.

Lawmakers could alternatively create a rigid “Air Traffic Code for Flying Cars.” This would limit the areas they could fly in, would likely require lawmakers to pay private citizens for taking property, and the entire industry would continue its sclerosis. How confident are we that they’ll get it right?

Is this government overreach, or is it commercial entities encroaching on people's rights and freedoms because they don’t want to pay for access, or something else?

Understanding the hoops commercial drone companies need to jump through to become operational is essential. But this is just the normal course of business. The fundamental truth is that all these certificates, blessings, and deliveries of medicine to old folks' homes do not give drones a special place in the US Constitution or remove them from operating legally.

The Certifications

Commercial drones are pushing to fly Beyond Visual Line Of Sight (BVLOS), the next frontier in unmanned aircraft operations. BVLOS reduces costs by eliminating the need for human observers, but it requires FAA approval and access to private airspace.

The FAA regulates BVLOS using rules and regulations that would make the most bureaucratic civil servant rejoice. These include Part 107, Part 91, and Part 135. So to fly BVLOS, drone operators need a Part 107 Remote Pilot Certificate, a Part 61 manned aircraft pilot license (in some cases), training on detect-and-avoid systems, a special airworthiness certificate or FAA exemption, and a Certificate of Waiver or Authorization (COA)

Part 91 governs larger drones and advanced operations, like cargo drones. Part 135 is for drone delivery services like Walmart and Amazon, which require certification to carry goods for hire. However, certification doesn't exempt drone companies from respecting private airspace and obtaining permission.

To scale BVLOS operations, drones may need FAA airworthiness approval, including type certification or special airworthiness certificates. Type certification involves a rigorous engineering review, while production certificates enable mass production of certified drones.

These operations require navigating many FAA regulations, but certification doesn't guarantee unrestricted access to private airspace. Drone companies must still respect property rights and obtain permission to operate.

Where the drones are manufactured is now becoming an even bigger issue, with bans on drones manufactured in certain countries for police work due to national security risks and tariffs changing incentives.

The main reason is that they can help boost the economy, make lives easier, and deliver significant wealth to those who own the air rights. Air rights can be traded, so knowing that low-altitude skies are needed is like knowing where the oil in the ground is and having an opportunity to stake your lot before the gushers flow.

The development of the skies, cargo drone highways, commercial drone delivery routes, and air taxis relies on the owners of air rights—the right to use and control air space.

Building out the infrastructure for the highways in the sky requires air rights resources. For example, UpWin Air Taxi, which is affiliated with Las Vegas Spaceport, has acquired the air rights for a helipad near Allegiant Stadium.

The company aims to transport people to games and concerts. The proposed ‘Raiders Station’ will feature four landing pads and a themed welcoming center. Flights will last around three minutes and cost $30 per person.

The plan is to develop a network of launch and landing pads across the Las Vegas Valley, including luxury hotels and entertainment venues. Once air taxis, called Electric Vertical Takeoff and Landing (eVTOL) vehicles, are certified, they will use the infrastructure. Cargo drones and lighter delivery drones are ready to start using the infrastructure for a fee and also use the air rights outside of the infrastructure airspace, which means private owners can look to benefit from this growth and help build the skyways.

Growth Opportunities

Knowing that this industry will develop in one upward direction shows a clear opportunity for those who own air rights to commercialize them.

Other examples include the Greater Orlando Aviation Authority investing in a vertiport, a landing and launching pad for air taxis at Orlando International Airport. This project will drive innovation and support the region's economic growth. The vertiport is expected to initially operate with passenger air taxis that can hold up to 6 people. They have stated they have plans to introduce corridors for flying cars.

What We Want

A recent survey of 1,000 U.S. adult fliers found that 98% would consider taking an eVTOL, or air taxi, as part of their travel journey. The main factor driving interest in air taxis is the potential to reduce overall travel time, with 47% of respondents citing "not having to sit in traffic" as a key motivator. Other factors include ease of use and convenience (61%), cost (61%), minimal environmental impact (44%), and the novelty of the experience (44%).

The survey also found that 79% of respondents would travel more often if they could take an air taxi to the airport. Millennials are the most enthusiastic about flying in an air taxi, with 65% expressing interest, compared to 58% of respondents. Business travelers are also more interested in air taxis than those flying for pleasure, with 60% versus 45% expressing interest.

The top reason for utilizing an air taxi is traveling between cities that are within 100 miles of each other, with 41% of respondents citing this as a desired use. For example, an eVTOL is expected to take under an hour to travel from New York to Philadelphia, compared to two to three hours by car. This opens up the need for infrastructure on private land and in private airspace, not just airports. This way, anyone with air rights and rooftops can benefit from this industry, and the need to be trapped in an airport is removed.

Overall, the survey shows significant demand for air taxi services, with the potential to transform the way people travel, reduce congestion in urban areas, and benefit from their air rights.
